EARLY ADOPTER PROGRAM TERMS AND CONDITIONS
Cyber Cert Labs Ltd (“We”, “Us”) invites you (“The Participant”, “You”) to participate in our Early Adopter Program. By joining this program, you agree to the following terms:
- Program Purpose
The purpose of this program is to provide you with knowledge and support and early access to our software and upcoming features in exchange for your active, constructive feedback, and insights to help shape the final product.
- Participation & Attendance Requirements
To maintain your status as an Early Adopter, you agree to the following commitment levels:
- Who: The Early Adopters Programme is for companies in scope for the Cyber Resilience Act who would be future users of the software platform Attestra. To be on the programme you must be a digital product manufacturer in scope.
- Workshop Attendance: You agree to attend at least 80% of the scheduled workshops/webinars.
- Make-Up Option: We understand that conflicts arise. If you cannot attend a live session, you may satisfy the attendance requirement for that session by watching the recording and submitting a summary or feedback response.
- Active Engagement: Passive observation is not sufficient. You agree to actively participate in workshop discussions and provide vital feedback.
- Non-Compliance: We reserve the right to remove participants from the program and revoke software access if attendance falls below the required threshold.
- Feedback & Intellectual Property
You will be asked to provide formal feedback via [surveys, interviews, written reports, etc.]. regarding the software’s usability, bugs, and feature requests.
- Assignment of Rights: You agree that any feedback, suggestions, ideas, or feature requests you provide to us are entirely voluntary.
- Ownership: To prevent future legal disputes, you hereby assign all rights, title, and interest in such feedback to Cyber Cert Labs. We are free to use, disclose, reproduce, license, or otherwise distribute and exploit this feedback as we see fit, entirely without obligation or restriction of any kind on account of intellectual property rights or otherwise.
- Confidentiality (The “NDA”)
During this program, you may be exposed to “Confidential Information,” including but not limited to: unreleased features, product roadmaps, UI designs, and strategic plans.
- Non-Disclosure: You agree not to disclose, publish, or share any Confidential Information with third parties (including on social media, blogs, or industry forums) without our prior written consent.
- Duration: This obligation of confidentiality persists until the information becomes publicly known through no fault of your own (e.g., when we officially launch the feature).
- Nature of the Software (Disclaimer)
You acknowledge that the software provided is a [Beta / Pre-release] version.
- “As Is” Basis: The software is provided “as is” and may contain bugs, errors, or stability issues.
- Data Security: While we take precautions, you should not use this environment for mission-critical data unless explicitly told otherwise. We are not liable for any data loss or system crashes experienced during the testing phase.
- Termination
- By You: You may withdraw from the program at any time by notifying us in writing.
- By Us: We reserve the right to terminate your participation and access to the software at any time, with or without cause, particularly for violations of the Confidentiality or Attendance clauses.
GENERAL TERMS AND CONDITIONS
Introduction
These Terms and Conditions (“Terms”) outline the rules and regulations governing your use of the Cyber Resilience Act Readiness Assessment web application (the “Application”) provided by Cyber Cert Labs Ltd (the “Company”). By accessing or using the Application, you agree to be bound by these Terms.
Acceptance of Terms
- 1. These Terms form a legally binding contract between you and the Company.
- 2. Your use of the Application is subject to Republic of Ireland law and jurisdiction.
- 3. You represent that you are at least 18 years old and have the capacity to enter into a binding agreement.
Data Collection and Privacy
We are committed to protecting your privacy and handling your personal data responsibly. Any personal information collected through the Assessment will be used in accordance with our Privacy Policy https://cybercertlabs.com/privacy-policy-for-cyber-cert-labs/. By using the Application, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.
Intellectual Property
All intellectual property rights related to the Applicaton, including but not limited to copyrights, trademarks, and patents, are owned by Cyber Cert Labs. You agree not to reproduce, distribute, or modify any content from the Application without prior written consent from the owner.
User Conduct
You agree to use the Application only for lawful purposes and in a manner that does not infringe upon the rights of others. Prohibited activities include but are not limited to:
- Violating any applicable laws or regulations.
- Posting or transmitting any content that is unlawful, harmful, or offensive.
- Interfering with the proper functioning of the Applicaiton.
Disclaimer of Warranties
The Application is provided “as is” and without warranties of any kind, whether express or implied. We do not warrant that the Application will be error-free or uninterrupted. You use the Application at your own risk.
Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way related to the use of the Application. This includes but is not limited to damages for loss of profits, goodwill, or data.
Indemnification
You agree to indemnify and hold harmless Cyber Cert Labs from any claims, damages, or losses arising out of your use of the Application or your violation of these terms and conditions.
Changes to Terms
We reserve the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the Application. Your continued use of the Application after the posting of changes constitutes your acceptance of such changes.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Irish courts.

Disclaimer Regarding Generated Reports
The Application may generate reports or other output based on the information provided by users. However, Cyber Cert Labs does not assume any responsibility for the accuracy, completeness, or usefulness of these reports. The reports are provided for informational purposes only and should not be relied upon for any decisions or actions. Users understand and agree that they use the reports at their own risk, and Cyber Cert Labs shall not be liable for any damages or losses arising from the use of the reports.
Marketing Communications
By using the Application, you may consent to opt in to receive relevant follow-on communications from Cyber Cert Labs regarding products, services, promotions, and other updates that may be of interest to you. These communications may be sent via email, SMS, or other channels. You have the right to opt out of receiving marketing communications at any time by following the instructions provided in the communications or by contacting us directly at contact@cybercertlabs.com. Please note that even if you opt out of marketing communications, you may still receive transactional or administrative messages related to your use of the Application.
